OFFICIAL RULES AND INFORMATION (2024-25 SEASON)

OVERVIEW: The Anaheim Ducks Foundation, Inc. (the “Ducks Foundation”) 50/50 Raffles (each, a “Raffle” and collectively, “Raffles”) at Anaheim Ducks home games at Honda Center located at 2695 E. Katella Avenue, Anaheim, California 92806, including all tickets, transactions, participants, purchasers, potential winners and winners, are subject to these Official Rules. A 50/50 raffle is a Raffle where the prize to the winning ticket holder is one-half (or fifty percent (50%)) of the gross receipts generated from the sale of Raffle tickets at a single Anaheim Ducks game. The remaining one-half (or fifty percent (50%)) of the gross receipts is retained by the Ducks Foundation to benefit or support its charitable purposes. This Raffle is subject to all applicable statutes, rules and regulations adopted by any regulatory and/or enforcement agency having jurisdiction with respect to the Raffle activities. The Raffle will be operated exclusively by the Ducks Foundation and not by the Anaheim Ducks Hockey Club, LLC (the “Anaheim Ducks”).
TICKET PURCHASE PROCESS: The Raffle will be conducted at select Anaheim Ducks home games at the Honda Center during the Applicable Season. Raffle tickets will be sold only in areas where a ticket is required for admission into the Honda Center. The Ducks Foundation reserves the right not to conduct a Raffle for any particular game. Raffle tickets can be purchased at the kiosk locations identified above in these Official Rules, or from an authorized roaming Raffle seller (wearing a blue shirt with a Ducks Foundation 50/50 logo) throughout Honda Center.
Tickets will be sold when Honda Center doors open to the general public (approximately ninety (90) minutes prior to game time) through the conclusion of the second (2nd) intermission of the game. The Ducks Foundation reserves the right to modify the conclusion of the Raffle for any reason and at any time with or without notice, including to close the Raffle early. Raffle tickets will be printed via an electronic system only when sold to an entrant. Preprinting electronic tickets is prohibited.
ENTRY: Tickets may be purchased with cash (U.S. dollars), credit card or debit card as follows:
· 3 entries for $10
· 10 entries for $20
· 80 entries for $40
· 300 entries for $100
Each ticket is the receipt for the entrant and represents one entry for one entrant for that game’s Raffle only. Tickets are not eligible for entry into past or future Raffles. There is no limit to the number of Raffle tickets an entrant may purchase for the Raffle, subject to availability. Raffle tickets are not transferrable. All sales of tickets are final, and no refunds shall be made under any circumstance. Raffle ticket purchases are not donations and are not tax deductible.
ELIGIBILITY: The Raffle is open to all ticket holders to an Anaheim Ducks home game who (i) are 18 years of age or older at the date of entry; (ii) are physically present at Honda Center at time of purchase; and (iii) provide valid government-issued identification, except as specifically excluded below. By purchasing a Raffle ticket, the entrant agrees to abide by all terms of these Official Rules and all applicable federal, state, local and municipal laws and regulations. Some restrictions apply. Void where prohibited or restricted by law.
No person affiliated with the Ducks Foundation, the Anaheim Ducks, Anaheim Arena Management, LLC or a registered manufacturer and distributor of Raffle-related products or services used for the Raffle, including any affiliated person, employee or agent may participate in the Raffle or receive a Raffle prize.
PRIZE: The total prize amount for each Raffle depends on the number of Raffle tickets sold for that particular Raffle. The prize will be one-half (or fifty percent (50%)) of the gross proceeds collected from the sale of the Raffle tickets for that Anaheim Ducks game (the “Prize”). The remaining one-half (or fifty percent (50%)) of the gross proceeds collected from the sale of Raffle tickets that are not distributed as a Prize will be used to benefit or support the charitable purposes of the Ducks Foundation.
DRAWING AND PRIZE WINNER DETERMINATION: Every transaction is electronically tallied. The jackpot total will be periodically displayed and updated on the scoreboard and various locations throughout Honda Center. As each Raffle ticket is sold during a game, a Raffle number ticket is concurrently printed and deposited into a secure drum. The secure drum only contains Raffle tickets purchased for that game. All Raffle ticket draw numbers will be unique and will not be duplicated. The equipment used to conduct Raffles and the method of play ensures that every Raffle ticket sold has an equal opportunity to be drawn as a winning ticket.
During the third (3rd) period of the Anaheim Ducks game, one (1) winning Raffle ticket will be drawn out of the pool of Raffle tickets contained in the secure drum. The winner need not be present to claim the Prize.
WINNER NOTIFICATION: The winning number and final jackpot will be posted on the scoreboard and verbally announced during the public address system during the third (3rd) period of the Anaheim Ducks game. The winning number and jackpot total will also be posted on the Anaheim Ducks website at www.anaheimducks.com/5050raffle within forty-eight (48) hours after the game or can be also obtained by emailing a request for the winning number at [email protected] with the subject “Raffle Winning Number Request”. The Ducks Foundation has no obligation to contact the winning ticket holder directly. In the event of a discrepancy between the actual number drawn and the announced number, the actual number drawn will be considered the valid winning ticket.
If for some unforeseen reason (e.g., weather delay, power outage, emergency, or other reasonably unforeseen event) the Raffle is not completed at the game at which the Raffle tickets are sold, the selection of the winning Raffle ticket from that Raffle will be completed the first business day that the Ducks Foundation’s normal business operations resume, and notice of the winning draw number will be posted on the Ducks Foundation website at www.anaheimducks.com/5050raffle.
PRIZE REDEMPTION PROCESS: The potential winner of the Raffle may claim the Prize at the (i) Raffle kiosk located at Section 212 at the Honda Center, or (ii) Ducks Foundation offices located at 1500 S. Douglass Rd. Suite 100, Anaheim, CA 92806 during regular business hours (Monday – Friday, 9:00 a.m. – 5:00 p.m.). In the Ducks Foundation’s sole discretion, the Ducks Foundation may permit claiming of the Prize in a manner other than set forth above. The potential winner may contact Ducks Foundation via the contact information included on each Raffle ticket, the contact information listed on the Ducks Foundation website at www.anaheimducks.com/5050raffle or by contacting the contact identified in the “Inquiries” section in these Official Rules.
All potential winners will have up to thirty (30) days following the conclusion of the applicable game date to claim the Prize. The purchased Raffle ticket is the only valid receipt to claim the Prize. The original ticket must be presented to the Foundation and reflect the winning draw number for the applicable game. A photocopy, photograph or reproduction of the receipt will not be accepted. The Prize may only be claimed by one (1) person. In the event more than one (1) person attempts to claim the Prize, the person who purchased the ticket shall be deemed the winner or if identification of such person cannot be confirmed by the Ducks Foundation, the Ducks Foundation may, in its discretion, require all persons attempting to claim the Prize to identify which person was the person who purchased the Raffle ticket or may disqualify all persons attempting to claim the Prize. A person presenting a winning Raffle ticket (the “potential winner”) will be required to present valid identification, complete an Affidavit of Eligibility and Release and required tax forms (supplying a valid social security number), and supply any other information requested by the Ducks Foundation necessary to determine eligibility and comply with applicable laws.
Following verification of eligibility and the completion of all required documentation, the Ducks Foundation will mail a check to the winner within forty-five (45) days of the claim date. No cash payments will be made to any winner.
Each winner will be subject to federal, state and local rules and regulations regarding gambling winnings, including those of the Internal Revenue Service and California Franchise Tax Board and acknowledges that the Ducks Foundation is required to comply with reporting requirements on Prize amounts imposed by state, local and/or federal laws, as applicable, and each winner acknowledges that the Ducks Foundation may, as the Ducks Foundation determines as necessary, collect some or all tax withholdings from the Prize prior to distribution to the winner. Each winner assumes all responsibility for any state, local or federal taxes, fees or other government assessments on the Prize amount. Each winner is advised to consult winner’s own tax advisor(s) with respect to the liabilities that may arise from entering the Raffle and winning the Prize.
If the potential winner fails to claim the Prize in the time period above, is determined to be ineligible, fails to submit identification or the required documents to the Ducks Foundation within the specified time period, or otherwise fails to comply with these Official Rules all as determined by the Ducks Foundation in its sole discretion, the potential winner will be disqualified, the Prize will be forfeited and the Prize will be retained by the Ducks Foundation. Winners may also choose to waive their right to receive the Prize, at which time the Prize from that Raffle will be forfeited and the Prize will be retained by the Ducks Foundation.
The Ducks Foundation is not responsible for any lost or stolen Raffle tickets.
PERSONAL INFORMATION: The Ducks Foundation may use entrant’s contact details and financial information to contact the entrant regarding the Raffle, provide entrant relevant information about promotions or marketing materials, to process the Raffle ticket transaction, and/or to provide entrant with the purchased Raffle tickets. PUBLICITY RELEASE: By accepting a Prize, each winner agrees to allow the Ducks Foundation the perpetual right to print, publish, broadcast and use worldwide in any media now known or developed hereafter, the winner’s name, biographical information, photograph, voice, likeness and statements for any purpose, commercial or otherwise, including but not limited to promotion, advertising, publicity and other communications without additional compensation, except where prohibited by law.
REGISTRATION INFORMATION: The Ducks Foundation is a recognized 501(c)(3) charitable organization and is incorporated under the laws of California. It is a separate legal entity from the Anaheim Ducks (the legal entity that owns and operates the Anaheim Ducks NHL franchise). The Ducks Foundation is conducting the Raffle with the permission of and limited assistance from the Anaheim Ducks, but the Ducks Foundation is solely responsible for the operation and conduct of the Raffle. The official registration number assigned to the Ducks Foundation is identified at the top of these Official Rules.
AGREEMENT TO OFFICIAL RULES, BINDING NATURE, RELEASE, INDEMNIFICATION: By purchasing a Raffle ticket, each entrant fully and unconditionally agrees to and accepts these Official Rules. The decisions of the Ducks Foundation with respect to each Raffle is final and binding. Each entrant agrees to release, indemnify, defend and hold harmless the Ducks Foundation, Anaheim Ducks, Anaheim Arena Management, LLC, NHL, and each of their respective parent, subsidiary or affiliated companies, and each of their respective shareholders, employees, directors, officers, affiliates, representatives, agents, successors, and assigns (collectively, “Released Parties”) against any and all liability, claims, actions, losses, damages, lawsuits, costs and expenses (including, without limitation, reasonable attorneys’ fees) of any kind whatsoever arising directly or indirectly for injuries (including death), damages or losses to persons and property, which may be sustained in connection with the Raffle, participation in the Raffle, receipt or use of any Prize, or while preparing for, participating, in, and/or traveling to any Prize-related activity.
Without limiting the foregoing, an entrant’s sole and exclusive remedy for any claim against the Ducks Foundation arising out of the sale of Raffle tickets or the conduct of the Raffle shall be limited to the return of the purchase price paid for his/her Raffle ticket(s). In no event shall the Released Parties be liable to any party or ticket purchaser for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY INJURY OR DAMAGE, WHETHER TO ENTRANT OR ANY OTHER PERSON OR TO ANY PROPERTY, RELATED TO OR RESULTING FROM ENTRANT'S PARTICIPATION IN THE RAFFLE, AND/OR ACCEPTANCE OR ATTEMPTED ACCEPTANCE OF ANY PRIZE OR USE OF THE PRIZE. BY PARTICIPATING IN THE RAFFLE, ENTRANT EXPRESSLY ASSUMES ALL LIABILITY AND RESPONSIBILITY FOR ENTRANT'S PARTICIPATION AND AGREES THAT PARTICIPATION IS SOLELY AT ENTRANT'S OWN RISK.
TAMPERING; ADDITIONAL LIMITATIONS OF LIABILITY: The Ducks Foundation, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or otherwise in violation of the Official
Rules. The Ducks Foundation further reserves the right to cancel, terminate or modify the Raffle for any reason, including, but not limited to, if any Raffle is not capable of completion as planned due to tampering, attempted tampering, unauthorized intervention or technical failures of any sort, fraud, acts of God, or any other reason. The Ducks Foundation will not be responsible for typographical, printing or other inadvertent errors in these Official Rules, in the announcement or mis-announcement or failure thereof of the winning draw number, printed tickets, or in other materials relating to any Raffle or for Entries that are lost, stolen, misdirected, damaged, incomplete, ineligible, or contain other problems that may limit the entrant’s ability to participate in any Raffle or win the Prize. The Ducks Foundation reserves the right in its sole discretion to deem void any ticket found suspect or deem any entrant ineligible to win the Prize if such entrant’s acts are or appear to the Ducks Foundation to be false, deceptive or misleading. Released Parties make no warranty, guaranty or representation of any kind concerning any Prize and disclaim any implied warranty. Failure of any Released Party to enforce any term of these Official Rules shall not constitute a waiver of any provision in these Official Rules.
GOVERNING LAW AND DISPUTE RESOLUTION: These Official Rules and the Raffle in all respects shall be governed by, construed and interpreted in accordance with the laws of the State of California, applicable to contracts entered into and performed exclusively in that State. As a condition of entering the Raffle, each entrant agrees that any and all disputes, claims, controversies, or causes of action arising out of or relating to this Raffle or any Prize awarded (“Claims”) shall be (1) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party (except to the extent prohibited by law), and (2) settled by binding arbitration in Orange County, California before a single arbitrator appointed by Judicate West in accordance with its then-governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses.
Any attempt to deliberately damage or undermine the legitimate operation of any Raffle may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should such an attempt be made, the Ducks Foundation reserves the right to seek remedies and damages (including attorneys’ fees) to the fullest extent of the law, including request for criminal prosecution.
