PURCHASE AGREEMENT FOR TICKETS

Preamble

Thank you for using the online ticketing service (the “Service”) of Ticketmaster (i.e., Account Manager or Ticketmaster.ca), Montreal Canadiens, FEVO or 4NF (each, an “Authorized Ticket Outlet”) to purchase tickets (each, a “Ticket”) to one or more of the following four (4) games (each, a “Game”) scheduled to be played at Bell Centre (the “Venue”) as part of the 2025 4 Nations Face-Off, a seven-game international ice hockey tournament (the “Event”), jointly organized by 4NF (defined below):

Sat., Feb. 15, 8:00 pm ET - USA vs. CAN

Your purchase of Tickets through the Service (individually or in a “strip” (i.e., one (1) Ticket for all four (4) Games scheduled to be played at the Venue) is subject to the terms of this Purchase Agreement for Tickets (the “Agreement”). When reference is made to the “Agreement” it shall also include the Terms of Use that you can consult at https://www.nhl.com/info/terms-of-service and the respective Privacy Policies at https://www.nhl.com/privacy, and https://www.nhlpa.com/privacy-policy which are all incorporated by reference herein as if recited at length. If there should be inconsistencies between the Agreement and the Terms of Use or either Privacy Policy, the Agreement shall prevail.

PURCHASER’S RELATIONSHIP WITH THE SERVICE USED TO PURCHASE, TRANSFER AND/OR RECEIVE ANY TICKET(S) IS GOVERNED BY THE TERMS AND CONDITIONS OF SUCH SERVICE (E.G., TICKETMASTER TERMS OF USE OR FEVO TERMS OF USE).

By purchasing and/or using one or more Tickets through the Service, you agree to be bound by the Agreement, and agree that (1) each Ticket is a revocable license, (2) use of a Ticket and admission to the Venue for the Event is conditioned upon your agreement to the terms and conditions set forth herein, and (3) you will inform any and all guests, companions, or other persons, including any minor (“Minor(s)”), who receives and/or uses a Ticket from you (each, an “Accompanying Party”) that as a ticket holders (each, a “Holder”), their own use of such Tickets and admission to the Venue is conditioned upon and confirms their agreement to foregoing and the terms of this Agreement. If you do not agree with the foregoing, do not purchase Tickets. If you have any questions about this Agreement, please contact us at 1-877-668-8269. This preamble shall form an integral part of the Agreement.

Parties

The parties to the Agreement (the “Parties”) are:

(hereinafter referred to as “4NF”)

- AND -

You (also referred to as the “Purchaser”, and may be written as “You” or “you”)

Definitions:

Dispute” shall be defined as any dispute, claim, or controversy arising out of or relating to these terms, the event, tickets, other applicable terms and conditions or event policies (defined below), or purchaser’s relationship with the Tournament Parties whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. Dispute shall be interpreted broadly. Dispute shall also include any dispute, claim, or controversy that arose before Purchaser assented to these terms or after the conclusion of the Event. Notwithstanding the foregoing, dispute shall not include disputes, claims, or controversies concerning patents, copyrights, trademarks, trade secrets, and claims of piracy or unauthorized use of any Service used to purchase Tickets. Purchaser and/or the Tournament Parties may seek interim or preliminary relief from a court of competent jurisdiction as needed to protect the status quo pending final resolution of the Dispute; however, the Parties acknowledge and agree that Purchaser, through their agreement to these terms, is expressly prohibited from seeking any equitable relief to enjoin or delay the Event, or the publication, exhibition, distribution, exploitation or other promotion thereof in any manner or media.

NHL” shall mean NHL IHT US, LP, NHL IHT, INC., NHL IHT CANADA HOLDCO, INC., NHL IHT US GP, LLC, NHL IHT US HOLDCO, LLC, The National Hockey League (“League”), NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC, NHL Network US, L.P., NHL Network US, Inc., National Hockey League Enterprises Canada, Inc., and NHL Enterprises, Inc.

NHL Parties” shall include NHL, the League’s Member Clubs, and each of their respective employees, directors, officers, agents and representatives.

NHLPA Parties” shall include the National Hockey League Players’ Association (“NHLPA”) and its past and current members, NHLPA World Cup GP Inc., Hockey Ventures (Canada) Inc., and each of their respective employees, directors, officers, agents and representatives.

Tournament Parties” shall mean 4NF, the NHL Parties and the NHLPA Parties.

Venue Parties” shall mean L’Aréna des Canadiens Inc., any of its affiliated companies and their respective employees, directors, officers, agents and representatives.

Purchased Ticket

You hereby agree to purchase and 4NF agrees to sell the Ticket(s) detailed in your Order Confirmation (as defined below). The purchase of the Ticket(s) grants each Holder the revocable license to attend the Game described on the Ticket(s). No other relationship between the Tournament Parties and the Holder, either expressed or implied, is created by your purchase of the Ticket(s). Children under the age of 24 months can enter Bell Centre for free but must sit on the lap of the accompanying adult.

Order Confirmation

Once your order is confirmed and your payment completed, you will receive a confirmation page and/or email indicating a confirmation number (the “Order Confirmation”). You must keep your confirmation number.

If, for any reason whatsoever, you do not receive a confirmation number or if you receive an error message or encounter a service interruption while you are completing the purchase of your Ticket(s), it is your entire responsibility to contact our Ticket Service Department (by phone at 1-877-668-8269 or by email at [email protected] or [email protected] to confirm whether your order has been properly processed. You are solely responsible for any problem that may occur during the purchase of Ticket(s). In such case, 4NF shall not be responsible for any loss (monetary or otherwise) that may result from any problem occurring during the purchase of Ticket(s) through this website, including, without limitation, the failure of a transaction to be completed or confirmed, whether through the actions of 4NF and/or its related entities, or a third party.

Orders will be processed only after a billing address and other billing information have been verified. Incorrect billing or credit card account information can delay the processing of the order and the delivery of the Ticket(s). In such case, 4NF’s Ticket Service Department may attempt to contact you, using the information provided at the time of purchase. If 4NF is unable to reach you after an initial attempt, it reserves the right to cancel your order and sell your Ticket(s) to another customer.

Obligation to Pay

By accepting the terms of this Agreement, you agree to pay the full price of the Ticket(s) ordered, including any applicable taxes and delivery, convenience and other fees, as described on the Order Confirmation page or e-mail. Ticket(s) prices are stated in Canadian Dollars.

Refunds and Exchanges

You must review your Ticket(s) selection before you submit and confirm your order. Subject to the provisions below for cancelled and/or altered Games, there are no exchanges or refunds once the Ticket(s) have been purchased. Please see the Refund Policy.

Delivery

The Ticket(s) shall be delivered immediately via e-mail at e-mail address you indicate on the Service on the day of purchase once payment has been processed. Note that certain delays and fees are applicable depending on the delivery mode you choose.

Cancelled and/or Postponed Events

You have the sole responsibility of verifying if any Game for which you have purchased Tickets through the Service is cancelled, altered, postponed or rescheduled as only the Purchaser (i.e., the person who purchases valid Tickets from an Authorized Ticket Outlet) may seek a refund under the terms of this Agreement. Except as required by applicable law, neither 4NF nor any Authorized Ticket Outlet shall have any obligation to any other person pursuant hereto, regardless of whether such person is a Holder, Accompanying Party, or a purchaser of Tickets from another outlet or source.

Please note that any Game may be cancelled or altered (in whole or in part) at the discretion of 4NF for any reason, including, but not limited to, weather, public health and safety, or governmental order. The time and/or date of any Game may also be changed for any reason at the discretion of 4NF. If rescheduled, such Game will be held at the Venue either at a different time than set forth above on the originally scheduled date (the “Event Date”) or at any time on another date between February 10, 2025 and February 17, 2025 (an “Alternate Event Date”) and the originally issued Ticket will provide admission to the rescheduled Game. No refunds or exchanges will be issued by any Authorized Ticket Outlet, if a Game is delayed, postponed or otherwise rescheduled and later played at the Venue on the Event Date or an Alternate Event Date. No part of the price paid by Purchaser to the Authorized Ticket Outlet will be refunded or credited for failure to use the Ticket to attend any rescheduled Game on the Event Date or an Alternate Event Date.

All Ticket sales are final, and no refunds or exchanges are permitted, save and except as expressly provided below or as otherwise required by applicable law. If any Game is (i) cancelled, (ii) played in a different venue than the Venue, or (iii) altered in such a way that 4NF, in its sole discretion, prohibits use of certain Tickets for entry into the Venue, Purchaser will be entitled to a refund from the applicable Authorized Ticket Outlet as its sole and exclusive remedy, and under no circumstances will be entitled to any special, incidental, or consequential damages unless required by applicable law. The foregoing is subject to the following terms and conditions:

  • Purchaser will receive a refund for the cancelled or altered Game (as provided above) directly from the Authorized Ticket Outlet used by Purchaser. The applicable Authorized Ticket Outlet will only refund Purchaser. Any person who purchased a Ticket from a source other than an Authorized Ticket Outlet will not be entitled to a refund from any Authorized Ticket Outlet. Such person will need to seek a refund, if applicable, directly from the party from whom any such Ticket was purchased.

◦ With respect to any Ticket(s) purchased by Purchaser from an Authorized Ticket Outlet as part of a strip for which any Game is cancelled, relocated or altered, a pro rata portion of the total price paid for such strip (i.e., one-fourth (1/4) if one of the four Games is not played) will be refunded in accordance with these terms.

  • Proof of Ticket purchase from an Authorized Ticket Outlet is necessary to claim any refund. Purchaser should retain Order Confirmation, original purchased Ticket(s) and a receipt which verifies the purchase of such Ticket(s) from the applicable Authorized Ticket Outlet.
  • Purchaser will be issued a refund of the Ticket price paid by Purchaser to the Authorized Ticket Outlet for such Ticket(s), plus any fees, taxes, charges, processing fees, delivery fees, etc. charged at the time of Ticket purchase. In no event will any other amounts be refunded unless required by applicable law or the applicable payment network rules.
  • The Authorized Ticket Outlet will issue any refunds permitted under this policy to the same method of payment used by Purchaser for the original purchase (for example, if a credit card was used to make the Ticket purchase, then that same credit card will be credited for the refund). Notwithstanding the foregoing, the Authorized Ticket Outlet reserves the right, in its sole discretion, to issue the refund to an alternative payment method to the extent permitted by payment network rules given the facts and circumstances surrounding the refund (for example, if the credit card used for the initial ticket purchase is no longer active).

Right to Cancel Tickets, Refuse Access and Expel

4NF reserves the right to cancel any Ticket(s) or order of Ticket(s) through the Service and to institute legal proceedings against Purchaser if you breach any provision of the Agreement or the Service. 4NF reserves the right to request photo ID of any Holder. Anyone carrying a backpack will be denied access to the Venue.

Ticket(s) purchased from any Authorized Ticket Outlet are revocable licenses and admission to any Holder may be refused for any reason (or no reason) at the sole discretion of 4NF, its employees, agents, officers or representatives, upon refunding the Ticket’s face value. Ticket(s) shall not otherwise be redeemable for cash.

Purchaser shall review carefully, and abide by, the policies of 4NF and the Venue Parties, including without limitation the Fan Code of Conduct, the Fan Guide for the Event, Venue security procedures, and any Venue rules, protocols, or procedures 4NF or the Venue Parties may require compliance with or verification of prior to or as a condition of admission to the Venue, as applicable (collectively the “Event Policies”). 4NF reserves the right in its sole discretion to refuse admission to or eject any person that fails to abide by any Event Policies, which may be modified without notice.

Recording, Transmission and Publication

By using a Ticket to attend the Event, You and each Holder, on behalf themselves and any Accompanying Parties, including Minor(s), grants the Tournament Parties and each of their respective affiliates permission to record their image, name, voice, likeness, actions and/or statements in any image, footage, or display, whether live or recorded, which may be taken at the Event or in and around the Venue, and to the use of same by the Tournament Parties and each of their respective affiliates at any time, for any purpose (including advertising or promotional purposes), and in any media now known or subsequently developed without additional compensation.

Unauthorized Commercial Use Of Ticket/Unauthorized Transmission

Tickets may not be used for advertising, promotion (including contests and sweepstakes) or other commercial purposes without prior written consent of 4NF. Any non-editorial or commercial use of any Event Mark or Venue Mark is prohibited without prior written approval of 4NF or the Venue Parties, as applicable. Any unauthorized transmission, picture or other depiction or description of the Event, including, any Game action, Game information or other Venue activity is prohibited without prior written approval of the Tournament Parties.

Use of Personal Information

The Event is an international ice hockey tournament jointly organized by NHL IHT, LP and NHLPA WORLD CUP LIMITED PARTNERSHIP. By purchasing, receiving or using a Ticket, Purchaser and each Holder acknowledges and agrees that their contact information and ticket sales data (excluding for clarity, any payment card information) will be collected and shared among the Tournament Parties for their respective use in accordance with their respective privacy policies which you can consult here:

NHL Privacy Policy (Last Updated and Effective Date - September 22, 2023)

This Privacy Policy describes the manner in which NHL Interactive CyberEnterprises, LLC, and its affiliates, including NHL Enterprises, L.P., NHL Enterprises Canada, L.P., and the National Hockey League, as well as their independent charities, NHL Foundation U.S., Inc. and the NHL Foundation (collectively, the "NHL," "we," "our," "us") use information in operating our websites, our mobile and other apps, and any other service that displays or provides an authorized link or reference to this Privacy Policy (collectively, the "Services"). Except where prohibited by applicable law (which may include the Province of Quebec), any and all disputes, claims, or controversies arising under or in connection with this Privacy Policy shall be governed by the Dispute Resolution and Binding Arbitration provisions and Class Action Waiver and Jury Trial Waiver provisions of the NHL.com Terms of Service.

The official sites and apps of the Member Clubs of the National Hockey League are part of the NHL.com website and the NHL mobile app ("Member Club Services"). This Privacy Policy describes the collection, use, and sharing of information by the NHL. The Member Clubs are responsible for their own privacy policies and practices, and you should review the applicable Member Club's privacy policy for information about its practices with respect to a Member Club Service.

If you do not agree to your information being used in the manner described in this Privacy Policy, please do not use the Services.   1. Information We Collect and Receive.

We collect and receive the following categories of information:

Information You Provide Directly. We receive the information you choose to provide when using our Services.

For example, you may directly provide us with information in connection with certain uses of our Services, such as when you register for our Services, bid on or purchase products on our Services, sign up for NHL.TV, sign up to receive electronic or other marketing communications, sign up to learn more about our upcoming events, enter a contest or sweepstakes, comment on an article, communicate with customer service or use a chat feature on the Services, or complete a survey or questionnaire, including:

Identifiers such as your first and last name, username, mailing address, phone number, date of birth, email address and mobile phone number;

Commercial information, including payment information and a record of your purchases and services you have obtained;

Demographic information, such as language spoken, age, gender, race/ethnicity, household composition, income and size;

Information about your favorite Member Club and Member Club players and other preferences;

Photographs or videos; and

Other information about your use of our Services. If you use a "share with a friend" or "invite a friend" feature on our Services, we collect your name and email address, as well as the name and email address of your friend. We do not use the names or email addresses of your friends submitted in these circumstances for any purpose other than sending an email on your behalf, unless we obtain your or your friend's consent or receive this information independently. Please ensure that you only submit email addresses of individuals with whom you have a personal or family relationship and who would want to receive the email. We rely on you to ensure that you have obtained your friend or family member's consent to share their personal information with us.

If you apply for a job with us, we will collect your name, contact information and any information you provide to us in a resume or other job applicant materials. We and our service providers or third party recruiter use this information to assess your suitability for, and contact you about, current or future job opportunities with the NHL. With your consent (where required by applicable law), we may also obtain personal information from third parties such as background screening companies and employment references.

Information We Collect or Receive When You Use Our Services. We also collect or receive information when you use our Services. We collect some of this information using cookies, web beacons, and other technologies. For information on our use of cookies and similar tracking technologies, please see our Cookie Policy. This information that we collect automatically may be combined with other information about you in order to personalize content, communications and advertising based on your interests. Depending on how you access and use our Services, we may receive:

Internet or other electronic network information. This is information we automatically collect and store when you use and interact with our Services, including, for example:

Information about your interactions with our Services, including the content you view, the products you bid on or purchase, the amount of time spent on our Services, the date on which you accessed our Services, and information in cookies and similar technologies; and

Information about how you access our Services, including your browser or operating system, your Internet Protocol ("IP") address, and browsing history including the websites you visit before and after visiting our Services

Device information. This is information we collect and store concerning the device you use when you access our Services. (Note that by "device," we mean any equipment or technology you use to access our Services.) Device information may include, for example:

The type of device you are using (e.g., your particular brand of phone or tablet);

Certain device identifiers which may be unique to your device;

Your Internet service provider; and

Depending on your permissions, content you have stored on your device (e.g., contacts stored on your phone).

Location information.

This information may include specific geolocation data drawn from your device's GPS, Bluetooth and WiFi signals and nearby cell towers. We receive this information, for example, when you choose to use location-enabled services that we offer.

Inferences. We may generate inferences about your preferences and characteristics based on your use of the Services and other information we have about you.

Commercial information. We capture certain information automatically when you make purchases or obtain services from us, such as a record of the purchases and services you have obtained and information about the time of the purchase.

Information from Third-Party Sources. We receive information from third-party sources such as Member Clubs, Fanatics Retail Group North and its affiliates ("Fanatics"), other Business Partners, publicly or commercially available sources, and social networking services (with your consent where required by applicable law).

Member Clubs. We may receive additional information about you from Member Clubs. For example, we collect log and other information relating to your use of the Member Club Services, and we collect ticketing and other information from Member Clubs.

NHL Shop and NHL Auctions. We have engaged Fanatics to operate NHLShop.com, NHLShop.ca, and Shop.International.NHL.com (collectively, "NHL Shop") and Auctions.NHL.com ("Auctions"). We receive certain purchase information (such as the items you purchased but not your payment card information) from Fanatics, for example, when you make a purchase on NHL Shop. For information about Fanatics' privacy practices, please see the applicable Fanatics privacy policy.

Other Business Partners. We may receive information about you from other Business Partners, including when you sign up to receive NHL news and offers on a third-party site or while using a third-party service.

Publicly or commercially available sources. We may receive information about you that is publicly or commercially available, including from data vendors where we are permitted to do so.

Social networking services. If you choose to connect with social networking services while using our Services, we may receive certain information about you, such as your user name. Learn more about social networking services here.

We may combine the information we have collected or received about you in different ways, including to develop inferences about you. For example, we may infer information about your preferences for engaging with the NHL and its Member Clubs.

  1. How We Use the Information We Collect and Receive.

We use each of the categories of information we collect and receive for the following business purposes:

To provide our Services. We use the information we collect and receive to provide you with the Services you use or request. For example, we use this information to:

Create accounts and process your registration with our Services;

Process transactions, including purchases and donations;

Provide technical support and respond to user inquiries;

Notify you about updates to our Services or send other communications that are relevant to your use of our Services; and

Enhance our ability to detect and prevent fraud and potentially illegal activities in connection with our Services and otherwise enforce our Terms of Service.

To improve our operations and Services. We also use the information we collect and receive to provide content you may find relevant and interesting and to maintain and upgrade our operations and our Services. For example, we may use this information to:

Solicit input and feedback about our Services;

Identify and address technical issues on our Services;

Better understand the visitors who come to our Services and the content of interest to them; and

Customize your experiences on our Services based on location information or your online activities, including the content you view, the products you bid on or purchase, other Services of ours you use, and other information we collect and receive.

To understand fan engagement across the League. We use the information we collect and receive, including from Member Clubs and other third-party sources, for performing internal analysis and building models to better understand NHL fans and fan engagement across the NHL and its Member Clubs so that we can customize and improve our Services, advertising and communications. We also conduct surveys to better understand our fans and fan engagement across the League. Our surveys may request demographic information about you and your household on an optional basis. We use and analyze survey responses for the purposes described above and, if applicable, to better understand the make-up and diversity of our fans. Please see the Your Other Privacy Choices section for more information on the choices we provide you.

To provide effective advertising and marketing. We also use the information we collect and receive to provide ads for our Services and certain third-party services, and to send you promotional communications, although you have certain rights with respect to these practices, as described below under the Your Other Privacy Choices section. For example, we may use this information:

To show you ads (on and off our Services, including on third-party sites such as social networking services), including those that are based on your approximate location information and those that are based on your online activities over time, and across third-party sites and services ("targeted advertising"). For more information, see Section 4 below.

We also may provide a hashed version of your email address or other information to third parties for the purposes of serving relevant advertising to you or others on third-party sites (including social media platforms).

To send you electronic and other marketing messages about the NHL, Member Clubs, or third-party Business Partners of the NHL that may be tailored to your preferences, characteristics, interests and interactions with us - for example, content related to your favorite Member Club, your engagement with the NHL or its Member Clubs or areas of our website you have visited.

To measure and evaluate the effectiveness of online advertising campaigns; and

To administer your participation in our contests, sweepstakes, fantasy or interactive games, or other promotions. We also may use the information we collect and receive for other purposes that may be described to you at the point of collection or for which you provide your consent.

  1. How We Share the Information We Collect and Receive.

We may share information that we collect and receive with third parties when we have your consent or as described below.

We share information with the following types of third parties:

Our affiliates and related entities. We share information with current and future "affiliates," a term that includes our parent and subsidiary companies, joint venture partners, or other companies we control, are controlled by, or with which we are under common control for the purposes set out in this Privacy Policy. We also share information amongst these NHL entities, as well as the National Hockey League Foundation and the NHL Foundation.

Our service providers. We provide information to affiliated and unaffiliated service providers and others that perform certain functions or services for us, such as to host our Services and data, fulfill orders, provide products and services, manage databases, perform analyses or advertising services, administer our contests and sweepstakes, collect location data, provide location-based services, process credit card payments, provide customer service or chat features on the Services, or send communications for us.

Member Clubs. In addition to the information Member Clubs may collect about you in connection with your use of the Member Club Services, we may share information about you with our Member Clubs, including your contact information, demographic information, preferences, and information or inferences about your engagement across the NHL and its Member Clubs, and our Member Clubs may use this information for purposes including: customizing their advertising and communications and providing you with special offers, promotional materials, and other materials and information that may be relevant to you, improving their products and services, and performing internal analysis. Business Partners. When you consent to receive news and offers from them, we share information about you with select Business Partners, such as our sponsors, retailers, and broadcast partners, so that they can provide you with special offers, promotional materials, and other materials and information that may be of interest to you. You can view a list of some of our key Business Partners here. To opt out of receiving communications directly from these Business Partners, please contact the Business Partner. We also may disclose personal information with co-brand and other partners when you choose to be involved in their programs or where you provide your information to us in order to transact with, donate to, or otherwise interact with the partner. We are not responsible for the privacy practices of our Business Partners or other third-party partners, which may use your information for their own purposes.

Advertising partners. We may also disclose information to our advertising partners for targeted advertising purposes, including through the use of cookies, web beacons, and other technologies as described further in Section 4 below. Other parties in response to legal process or when necessary to protect us or our Services. We or our service providers may disclose your information -- including the contents of your communications -- to other parties when required or permitted by applicable law in the jurisdictions in which we or our service providers are located, such as when we have a good faith belief that:

Doing so is necessary to respond to lawful governmental requests or legal process (for example, a court order, search warrant, or subpoena);

The information is relevant to a crime that has been or is being committed;

An emergency exists that poses a threat to your safety or the safety of another person or persons; or

Doing so is necessary to protect our rights or property, defend against legal claims, or to enforce our Terms of Service.

Other parties in connection with certain business transactions. Limitation of Liability

By accepting the terms of the Agreement, Purchaser, on behalf of themselves and any Accompanying Party, including Minor(s), voluntarily assumes all risks of property loss and personal injury, illness and all other hazards related to attending the Event, whether occurring prior to, during or after the Game, including specifically but not exclusively, the danger of injury by hockey pucks, sticks and other equipment, by spectators or players, or by thrown objects, as well as effects related to infectious and/or communicable diseases/illnesses (including, human coronaviruses), and agrees that Tournament Parties, the Venue Parties, and each of their respective affiliates, parents, subsidiaries, agencies, departments, subdivisions, related entities, owners, governors, trustees, officers, directors, partners, shareholders, members, principals, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) are expressly released from any and all claims arising from or relating to such causes or otherwise occurring at or in connection with the Event or Game, excluding claims arising from or relating to the negligence of any Released Parties.

Furthermore, Purchaser hereby waives any and all rights to claim damages, monetary or otherwise, or to institute civil, criminal, administrative or legal proceedings against the Released Parties, resulting from any cause whatsoever arising either before, during or after the Event.

EXCEPT AS OTHERWISE PROHIBITED BY APPLICABLE LAW, IN NO EVENT WILL ANY RELEASED PARTY BE LIABLE TO HOLDER FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR FOR LOST PROFITS, REVENUES OR BUSINESS OPPORTUNITIES EVEN IF SUCH RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In certain cases, applicable laws may not allow the limitation of liability set forth above, so this limitation of liability may not apply in such particular cases. If any part of this limitation on liability is found to be invalid or unenforceable for any reason, then Released Parties’ aggregate liability under such circumstances for liabilities that otherwise would have been limited shall not exceed one hundred Canadian dollars (CAN$100).

Indemnification; Waiver of Jury Trial

You hereby agree to indemnify and hold harmless the Released Parties from and against any and all claims, actions, damages or other demands, including, but not limited to, reasonable costs and expenses of litigation such as counsel fees, arising from or relating to (i) your purchase of Ticket(s), or (ii) your attendance at the Event.

Purchaser and each Tournament Party waives any right to a jury trial.

General

Where a court of competent jurisdiction declares a portion of the Agreement invalid or unenforceable, the remainder of the Agreement shall remain in force.

The headings in the Agreement are provided for clarity only and do not form an integral part of the Agreement.

Where you have read the Agreement in English, the Parties agree that the Agreement shall be drawn up in the English language. You can also read the Agreement in French at nhl.com/fr/info/2025-4NF-Agreement.

Except as otherwise prohibited by applicable law, 4NF reserves the right to modify any provisions of this Agreement and/or any Event Policies without notice.

Ticket Conditions

The following paragraph appears on all printed Tickets and forms an integral part of the Agreement:

4 NATIONS FACE-OFF TICKET TERMS & CONDITIONS

THIS TICKET (“TICKET”) IS A REVOCABLE LICENSE. ANY PERSON PURCHASING AND/OR USING THIS TICKET (“HOLDER”) AGREES THAT (1) USE OF THIS TICKET FOR ADMISSION TO BELL CENTRE (“VENUE”) TO ATTEND A GAME OF THE 4 NATIONS FACE-OFF (“EVENT”) SPECIFIED HEREON (“GAME”) IS CONDITIONED UPON HOLDER’S AGREEMENT TO THE TERMS AND CONDITIONS SET FORTH BELOW (“T&Cs”), AND (2) HOLDER WILL INFORM ANY PERSONS, INCLUDING ANY MINOR (“MINOR(S)”), WHO RECEIVES AND/OR USES A TICKET FROM HOLDER (EACH AN “ACCOMPANYING PARTY”), THAT AS A TICKETHOLDER THEMSELVES, THEIR OWN USE OF SUCH TICKET AND ADMISSION TO THE VENUE IS ALSO CONDITIONED UPON AND CONFIRMS THEIR AGREEMENT TO FOREGOING AND THESE T&Cs. IF YOU DO NOT AGREE WITH THE FOREGOING, DO NOT USE THIS TICKET FOR ADMISSION.

THE T&Cs CONTAIN A SUMMARY OF PROVISIONS THAT APPLY TO HOLDER, ON ONE HAND, AND NHL IHT, LP AND NHLPA WORLD CUP LIMITED PARTNERSHIP (COLLECTIVELY, “4NF”), ON THE OTHER HAND. FOR THE FULL TERMS AND CONDITIONS, PLEASE VISIT NHL.COM/INFO/2025-4NF-MTL-SUPPLEMENTAL-TERMS (“SUPPLEMENTAL TERMS”). ANY TERM NOT DEFINED HEREIN SHALL HAVE THE MEANING SET FORTH IN THE SUPPLEMENTAL TERMS. PLEASE READ THESE T&Cs AND THE SUPPLEMENTAL TERMS CAREFULLY AS THEY MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS.

WARNING! DESPITE ENHANCED SPECTATOR SHIELDING MEASURES, PUCKS STILL MAY FLY INTO THE SPECTATOR AREA. SERIOUS INJURY CAN OCCUR. STAY ALERT AT ALL TIMES INCLUDING DURING WARMUP AND AFTER PLAY STOPS. IF STRUCK, IMMEDIATELY ASK USHER FOR DIRECTIONS TO MEDICAL STATION. HOLDER, ON BEHALF OF THEMSELVES AND ANY ACCOMPANYING PARTY, INCLUDING MINOR(S), VOLUNTARILY ASSUMES ALL RISKS OF PROPERTY LOSS AND PERSONAL INJURY, ILLNESS AND ALL OTHER HAZARDS RELATED TO ATTENDING THE EVENT, WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE GAME, INCLUDING SPECIFICALLY BUT NOT EXCLUSIVELY, THE DANGER OF INJURY BY HOCKEY PUCKS, STICKS AND OTHER EQUIPMENT, BY SPECTATORS OR PLAYERS, OR BY THROWN OBJECTS, AS WELL AS EFFECTS RELATED TO INFECTIOUS AND/OR COMMUNICABLE DISEASES/ILLNESSES (INCLUDING, HUMAN CORONAVIRUSES), AND AGREES THAT THE TOURNAMENT PARTIES, THE VENUE PARTIES, AND EACH OF THEIR RESPECTIVE AFFILIATES, PARENTS, SUBSIDIARIES, AGENCIES, DEPARTMENTS, SUBDIVISIONS, RELATED ENTITIES, OWNERS, GOVERNORS, TRUSTEES, OFFICERS, DIRECTORS, PARTNERS, SHAREHOLDERS, MEMBERS, PRINCIPALS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) ARE EXPRESSLY RELEASED FROM ANY AND ALL CLAIMS ARISING FROM OR RELATING TO SUCH CAUSES OR OTHERWISE OCCURRING AT OR IN CONNECTION WITH THE EVENT OR GAME, EXCLUDING CLAIMS ARISING FROM OR RELATING TO THE NEGLIGENCE OF ANY RELEASED PARTIES.

HOLDER IS BOUND BY ALL EVENT POLICIES AND REGULATIONS OTHERWISE IN FORCE AT THE VENUE, INCLUDING, SECURITY PROCEDURES AND THE FAN CODE OF CONDUCT. 4NF RESERVES THE RIGHT TO REFUSE ADMISSION TO OR EJECT ANY PERSON THAT FAILS TO ABIDE BY ANY EVENT POLICIES, WHICH MAY BE MODIFIED WITHOUT NOTICE. SHOULD ANY PART OF THESE T&Cs BE DEEMED INVALID BY A COURT OR ARBITRATOR, THE VALIDITY OF THE REMAINING PROVISIONS SHALL NOT BE OTHERWISE AFFECTED THEREBY.

BY USING A TICKET TO ATTEND THE EVENT, EACH HOLDER, ON BEHALF THEMSELVES AND ANY ACCOMPANYING PARTIES, INCLUDING MINOR(S), GRANTS THE TOURNAMENT PARTIES AND THEIR RESPECTIVE AFFILIATES PERMISSION TO RECORD THEIR IMAGE, NAME, VOICE, LIKENESS, ACTIONS AND/OR STATEMENTS IN ANY IMAGE, FOOTAGE, OR DISPLAY, WHETHER LIVE OR RECORDED, WHICH MAY BE TAKEN AT THE EVENT OR IN AND AROUND THE VENUE, AND TO THE USE OF SAME BY THE TOURNAMENT PARTIES AND THEIR RESPECTIVE AFFILIATES AT ANY TIME, FOR ANY LAWFUL PURPOSE, IN ANY MEDIA NOW KNOWN OR LATER DEVELOPED WITHOUT RECOMPENSE.

TICKETS MAY NOT BE USED FOR COMMERCIAL PURPOSES (INCLUDING CONTESTS, SWEEPSTAKES OR ADVERTISING) WITHOUT 4NF’S PRIOR WRITTEN CONSENT. ANY NON-EDITORIAL OR COMMERCIAL USE OF ANY EVENT MARK OR VENUE MARK IS PROHIBITED WITHOUT 4NF’S OR THE VENUE PARTIES’, PRIOR WRITTEN APPROVAL, AS APPLICABLE. ANY UNAUTHORIZED TRANSMISSION, PICTURE OR OTHER DEPICTION OR DESCRIPTION OF THE EVENT, INCLUDING, ANY GAME ACTION OR INFORMATION, IS PROHIBITED WITHOUT 4NF’S PRIOR WRITTEN APPROVAL.

4NF RESERVES THE RIGHT TO MODIFY ANY EVENT POLICY WITHOUT NOTICE. GAME DATES & TIMES AND TEAM ROSTERS & LINE-UPS ARE SUBJECT TO CHANGE. THE NUMBER OF PERIODS IN A REGULATION GAME SHALL BE DETERMINED BY 4NF AND MAY BE SHORTENED IN ACCORDANCE WITH EVENT RULES.
