PROMOTION
Seattle Hockey Partners LLC (“SHP”) and Brown-Forman Corporation invites fans to participate in the Jack Daniel’s Take-a-Shot Contest for a chance to win $500,000, subject to these Official Rules (the “Promotion”).
ADMINISTRATOR AND SPONSOR
The Promotion is proudly administered by SHP, located at 10601 5th Ave NE, Seattle, WA 98125 and sponsored by Brown-Forman Corporation (“Brown-Forman”).
WHEN IS THIS HAPPENING?
The Promotion will take place at five (5) separate Seattle Kraken home games at Climate Pledge Arena on the following dates: (i) October 8, 2024, (ii) November 16, 2024, (iii) January 23, 2025, (iv) March 1, 2025 and (v) April 15, 2025 (each, a “Promo Game” and collectively, the “Promo Games”).
ENTRY AND HOW TO WIN
For each Promo Game, one (1) contestant will be randomly chosen by Section, Row and Seat Number. If the individual sitting in that seat, at the time of selection, does not wish to participate, is not eligible and/or is disqualified from participation, another fan randomly chose using the same method will be invited to participate. Prior to participation, each participant must complete and sign a “Contestant Agreement to Participate” in the form provided by SHP.
Each eligible participant will have one (1) opportunity to shoot a regulation hockey puck (“Puck”) using a regulation hockey stick (“Stick”) completely through a target opening measuring a maximum of one and one half (1 ½) inches in height and three and one half (3 ½) inches in width from behind the opposite blue line, in each case, as determined by SHP. The participant must stand on the ice and may not stand on any form of artificial surface (carpet, rubber flooring, etc.). Nothing may be done to the surface of the synthetic ice to enhance the chances of scoring the goal (grooving, brushing, etc.). In addition, no part of the participant’s body or clothing may come in contact with the demarcation lines/spots prior to shooting the puck. Any such contact shall constitute a foul and the shot shall be considered missed. If the participant successfully shoots the Puck completely through the target opening, the participant will be awarded the Prize (defined below), subject in all respects to these Official Rules (each such winning participant, if any, a “Winner” and collectively, the “Winners”).
ELIBIGILITY
By participating in the Promotion and/or claiming the Prize (defined below) should you be a Winner, you certify that you are at least eighteen (18) years old and a legal resident of either the United States, excluding Puerto Rico, Guam, and all other U.S. territories and possessions, or of Canada, and agree to these Official Rules and SHP’s Terms of Use and Privacy Policy. Your eligibility for the Promotion is contingent upon these certifications. Participants CANNOT choose another person to participate on their behalf. No one participant may be selected to participate on more than one occasion. Participants shall not be permitted any practice, warm-up, or qualifying shots, at any time after their notification of participation in the Promotion until their actual attempt for a Prize. The participant may not be chosen more than two (2) hours prior to the start of the of the Promotion for the applicable Promo Game. No purchase or payment is necessary to enter or win; void where prohibited.
Employees, directors, officers, and agents of SHP, Seattle Arena Company, LLC (“SAC”) or any promotional agency involved in the Promotion and each of their respective parent companies, divisions, dealers, affiliates, subsidiaries, advertising and promotional agencies and suppliers involved in the Promotion, as well as the members of each of their immediate families (spouse, parents, children, siblings, and in-laws) and persons residing in the same household as such individuals are not eligible to enter or win. In addition, the following classes of people are not eligible to participate or win:
- Current or former Hockey Club and Junior Hockey League players and coaches who have played or coached at that level anywhere in the world within the past five (5) years.
- Current or former professional or semi-professional hockey players and coaches who have played or coached at that level anywhere in the world.
- Current or former collegiate or junior collegiate hockey players and coaches who have played or coached at that level anywhere in the world within the past five (5) years.
- Current or former collegiate club hockey players and coaches who have played or coached at that level anywhere in the world within the past five (5) years.
- Current or former Olympic hockey players and coaches who have played or coached at that level anywhere in the world within the past five (5) years.
- Current or former high school hockey players and coaches who have played or coached at that level anywhere in the world within the past five (5) years.
- Any person actively participating in the sporting event/tournament associated with the Promotion.
PRIZE
For each Game Period, one (1) participant will be eligible to win $500,000 (estimated retail value is $500,000), subject to the Prize award installment options set forth by OddsOn Promotions (the “Prize”). Limit one (1) Prize per household. Each Winner is solely responsible for paying any applicable local, state, or federal taxes related to the Promotion, as well as any costs and expenses associated with the Prize. Promotion winnings will be reported to the Internal Revenue Service and Winners can expect to receive a 1099 tax form for the Prize. Neither SHP, SAC nor Brown-Forman makes any warranty or guarantee regarding any Prize, express or implied, and the Prize is awarded on an “as-is” basis. By participating in the Promotion and accepting a Prize, each participant agrees to abide by all applicable laws as well as all policies in force at SHP, SAC and/or Climate Pledge Arena, as applicable. SHP and Brown-Forman reserve the right to substitute a Prize for a prize of equal or greater value if the original Prize cannot be honored for any reason. SHP and Brown-Forman further reserve the right, in their sole discretion, to refuse to honor a Prize if too few entries are received or if the participant or any guest a Winner selects to participate in a Prize (a “Guest”), as applicable, claiming it is unruly, disruptive, uncooperative, fails to comply with any policies of SHP, SAC and/or Climate Pledge Arena, or may or does cause damage to any person, property, or the reputation of SHP, SAC and/or Climate Pledge Arena. The Prize, including any additional restrictions, are at SHP’s and Brown-Forman’s sole discretion.
By claiming or accepting any Prize, each Winner certifies that they agree to the terms and conditions set forth in these Official Rules. Any Prize that is obtained in contravention of these Official Rules or the local, state, or federal law will be deemed void and will not be honored. The Prizes may not be sold or transferred. SHP and Brown-Forman will determine in their sole discretion whether the Prize has been improperly obtained, presented, or transferred.
REPRESENTATIONS AND INDEMNIFICATION
Each and every participant and each Winner hereby represents and warrants that they have read these Official Rules, are fully familiar with their contents, and agree to abide thereby. Each Winner shall be responsible and liable for the actions of any guest who partakes in a Prize, including any third party to whom a Prize is gifted, sold or transferred. Each participant further agrees to indemnify, defend, discharge, release, forever acquit, and hold SHP, SAC, Brown-Forman and their affiliated entities (including third-party partners) and their respective officers, employees, representatives, agents and contractors harmless against any and all demands, claims, actions, or proceedings of any kind, and from any and all injuries, damages, liabilities, costs, and expenses related to or arising out of the participation in the Promotion, the Prizes awarded, or any breach or alleged breach of any of the warranties, representations, or agreements of participants hereto. Each Winner and any guest who participates in a Prize in any way may be required by SHP, SAC and/or Brown-Forman to execute additional forms, releases, and/or waivers as a prior condition to participating in a Prize.
RELEASE OF LIABILITY; PUBLICITY RELEASE
Participants agree to obey all applicable laws and regulations, including any local guidance or mandates related to any pandemic at the time of the any event related to the Promotion or a Prize, and to be bound by these Official Rules. By participating in the Promotion, you fully and unconditionally release SHP, SAC, Brown-Forman, the City of Seattle and the NHL and its member clubs from (1) all claims for liability arising from or related to your participation in the Promotion and (2) all claims related to a participant or Guest’s acceptance, receipt, possession, loss, and/or misuse of any entry or Prize. SHP and SAC make no representations regarding the effects, condition, safety or potential exposure risks related to human coronaviruses, any pandemic-related precautions that are required or not required by SHP or SAC, or attendance at the event.
In the event SHP and Brown-Forman are unable to continue the Promotion or to honor any Prize due to any event beyond its control, including but not limited to technological errors, fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil unrest, terrorist threat or act, war (declared or undeclared), or any local, state, or federal law, order, or regulation, then subject to any governmental approval that may be required, SHP reserves the right to modify, suspend, extend, or terminate the Promotion and these Official Rules.
Each Winner, by acceptance of a Prize, grants to SHP, SAC, Brown-Forman, OddsOn Promotions and each of their respective designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.
DATA PRIVACY
Private or personally identifying information collected in connection with the Promotion may be retained by SHP and SAC, sold, shared with business partners and/or affiliates, or used for marketing purposes. By participating in the Promotion, you consent to SHP and SAC’s collection and use of your personal information as described in our privacy policy available here: https://www.nhl.com/kraken/info/privacy.
DISPUTES
The Promotion and these Official Rules are governed by the laws of the United States and the State of Washington. As a condition of participating in the Promotion, participants agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with the Promotion, shall be resolved individually, without resort to any form of class action, by final and binding arbitration administered by JAMS and conducted in Seattle, Washington before a sole arbitrator in accordance with the rules of JAMS.
Residents of the Province of Quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
