2024-25 SEASON TICKET SUBSCRIPTION TERMS AND CONDITIONS
ALL PAYMENTS AND DEPOSITS ARE NON-REFUNDABLE
These Season Ticket Subscription Terms and Conditions ("Terms and Conditions") govern the purchase by the person or entity identified as the Season Ticket account holder ("you") of season tickets ("Season Tickets") for those certain seats ("Seats") designated in the attached invoice ("Invoice") for Boston Bruins pre-season and regular season National Hockey League ("NHL") games at the TD Garden ("Games"). By payment of any deposit or amount set forth in the Invoice, you hereby accept and agree to be bound by these Terms and Conditions, which constitute an agreement between you and Boston Professional Hockey Association, Inc. ("BPHA").
TERMS AND CONDITIONS
Revocable License. Subject to these Terms and Conditions and your payment of amounts immediately due on the Invoice, you will have a personal, revocable license to use Season Tickets. Use of the Season Tickets and attendance at any Game are also governed by (i) the terms and conditions set forth on the individual Game tickets ("Ticket Policies"), (ii) TD Garden policies, including security, alcohol, COVID-19, health and safety and appropriate conduct policies ("TD Garden Policies"), and (iii) applicable law. BPHA can at its sole discretion cancel an account without notice for any reason at any time and provide a refund for amounts paid that are applicable for tickets for Games not yet played. The foregoing license is personal to you, and you may not assign or transfer any rights or benefits with respect to your Season Ticket account to anyone else without the prior written approval of BPHA.
Prices. BPHA expressly reserves the right at its sole discretion to determine the prices for Season Tickets set forth on the Invoice.
Payment. You agree to pay in full the amounts set forth on the Invoice and any subsequent Invoices by the date such payments are due. Failure to pay by the invoiced dates may result in cancellation of Season Tickets and any additional benefits.
Form of Season Tickets. Season Tickets will be provided in a form of a mobile ticket.
No Refunds. All sales of Season Tickets are final. All payments and deposits are non-refundable. No refunds or exchanges of Season Tickets will be made.
NHL Events. You acknowledge and agree that Season Tickets purchased hereunder are solely for 2024- 2025 NHL preseason and regular Games presented by BPHA and played at the TD GARDEN, and for the avoidance of doubt, shall not include tickets, or the right to purchase tickets, to any other event or game, including, but not limited to, any NHL European Global Series Games, NHL China Games, NHL Winter Classic, NHL Heritage Classic, NHL Stadium Series, NHL All-Star or NHL Draft event ("League Special Event") to the extent held in the Boston Bruins market or hosted by the NHL at the TD Garden or otherwise in which the Boston Bruins may participate. You acknowledge and agree that BPHA and/or NHL may cancel, postpone, reschedule or relocate Games or events for any reason (e.g., move a regular season Game of the Boston Bruins from the TD Garden to an alternate venue for the purposes of playing a League Special Event), as determined in its/their sole discretion, as well as to modify or discontinue, temporarily or permanently, any aspect of the rules, operations and presentations of NHL Games and events ("Preemption"). In the event that any Game or event for which tickets have been sold to you is not played or presented in the TD Garden for any reason, including, but not limited to, Preemption, such Game or event shall in no way be deemed, argued or construed to be a breach by BPHA of any terms, conditions, agreement or any other duties or obligations in connection with the sale and use of these Season Tickets and, in such event, your sole remedy shall be a pro-rata account credit or refund equal to the price paid for these Season Tickets as specified in the Invoice, and you hereby waive and release any and all claims it may have against the Boston Bruins, BPHA, and/or the NHL with respect to such Game(s) or event not played or presented at the TD Garden."
2024-2025 Season. Your license to purchase and use Season Tickets is effective upon payment of amounts in the Invoice and applies to the Games starting in September 2024 and ending in April 2025 ("2024-25 Regular Season").
2024-2025 Playoff games. If you are in good standing under these Terms and Conditions and are current and fully paid up with respect to your Season Tickets for all Games in the Regular Season, you will be provided with the opportunity to purchase tickets to use the seats at NHL Playoff Games for the 2024-25 Regular Season. If it appears that the Boston Bruins are likely to qualify for postseason play, you will be notified with the terms of any such purchase, including applicable prices, deposits and/or deadlines. Any such purchase will be solely only on the terms offered, which may include higher per-Seat prices, the payment of a deposit, or terms which are in addition to or different from these Terms and Conditions. If you decline, or do not meet any applicable purchase deadlines or requirements, the Seats may be offered to third parties or the general public for any playoff Games for the 2024-25 Season.
Next Season. If you are in good standing under these Terms and Conditions and are current and fully paid up with respect to your Season Tickets for all Games in the 2024-25 Regular Season, you may be provided with the opportunity to purchase Season Tickets for the 2025-26 NHL Regular Season. The purchase terms for Season Tickets for the 2025-26 NHL Regular Season may change, including prices, deposits, restrictions, payment plans, Game packages and/or deadlines. Any such purchase of Season Tickets for the 2025-26 NHL regular season will be subject to and in accordance with the purchase terms applicable to that season. BPHA will use reasonable efforts to offer you the same Seats as your Season Tickets for the 2025-26 NHL regular season, but BPHA expressly reserves the right at its discretion to change the number or location of Seats or to decline to sell you Season Tickets for the 2025-26 NHL Regular Season or future seasons at its discretion.
Termination. Your license and other benefits under these Terms and Conditions, including the license to purchase and use Season Tickets and the opportunity to purchase and use playoff tickets for the Seats, may be terminated immediately without notice in the event that (i) you breach these Terms and Conditions, including your non-payment of any invoiced amounts when due, (ii) you or anyone using the Seats engages in inappropriate or improper conduct, or violates or breaches any Ticket Policy or TD Garden Policy, (iii) you or anyone using the Seats violate applicable laws or regulations related to the Tickets or attendance of Games, and/or (iv) you attempt to assign or transfer any rights or benefits with respect to your Season Ticket account to anyone else without the prior written approval of BPHA.
Lost or Stolen Tickets. You are solely responsible for lost or stolen mobile tickets. The risk of loss passes to you once the tickets are sent to you by BPHA. Please keep your tickets secure. BPHA may at its sole discretion issue substitute tickets for lost or stolen tickets, but is under no obligation to do so. The only tickets honored will be those that carry the proper date and game designation or have the applicable unique bar code.
Tickets. You may not transfer, resell, or assign to anyone else (i) your license to purchase Season Tickets, (ii) any opportunity to purchase tickets to playoff Games, or (iii) any other benefit related to Season Tickets. The Season Tickets are revocable licenses and may be revoked at BPHA's discretion. These Terms and Conditions do not confer any property right to you. You hereby acknowledge that BPHA may cancel or revoke tickets, and terminate any benefits related to Season Tickets, for certain conduct including, but not limited to, (i) any form of fraudulent activity; (ii) the purchase of tickets for the purpose and intent of reselling the tickets on the secondary market as a business; (iii) use of tickets for sweepstakes, contests, and/or promotions without the prior written consent from BPHA; and (iv) any resale of Season Tickets (or any portion thereof) in violation of applicable law.
Resale: If you resell at least 60% of your 41 game tickets by February 1 for the 2024-25 Regular Season, you will be subject to further review by the organization. If it's determined that you are a High Volume Reseller, you will not be able to renew your Season Tickets for 2025-26 and onward. TD Garden Account Manager is the only platform where resale is allowed. Reselling your Season Tickets for any game outside of TD Garden Account Manager is strictly prohibited and will result in cancellation of your Season Tickets.
Tickets Invoice. The Terms and Conditions that are enclosed, attached and referenced herein shall be expressly part of this invoice, incorporated herein by reference, and shall govern the transactions contemplated in this invoice, whether in hard copy, or electronic.
Additional Benefits. BPHA may at its sole discretion provide additional benefits related to or in connection with your Season Tickets. Any such benefits will be personal to you and may not be resold or assigned to any third party, and BPHA may change or eliminate any such benefits, or decline to offer them to you, at its sole discretion.
Responsibility. You as the Season Ticket holder will be responsible for any liability or damages caused by your conduct or the conduct of anyone else using the applicable Seats. Inappropriate behavior, improper conduct or violations of law by anyone using such Seats at Games will be deemed to be a breach of these Terms and Conditions by you, and may result in the termination of your license to purchase and use Season Tickets, including the cancellation of tickets already issued to you, and the denial of any opportunity to purchase tickets for the Seats for playoff Games.
Season Ticket Account. Only the person or company named on the Invoice is allowed to conduct transactions involving the Season Tickets. BPHA retains the exclusive right to settle, in its sole discretion, any and all disputes concerning the identity of the Season Ticket holder of record. Changes to account information, including the identity, credit card information and/or address of the Season Ticket account holder, are at the discretion and subject to the requirements of BPHA.
Reservation of Rights. BPHA expressly reserves the right to (i) change any Ticket Policy or TD Garden Policy at any time and for any reason; (ii) change any of these Terms and Conditions, Season Ticket prices or other policies, playoff terms and conditions, and terms of purchase for subsequent seasons at any time and for any reason; (iii) apply changes or enforce these Terms and Conditions differently with respect to different persons or entities; and (iv) charge an administrative fee in connection with any change in Season Ticket holder account information.
Governing Law. These Terms and Conditions are governed by Massachusetts law.
Changes to the Terms and Conditions. No change, waiver, modification or amendment of these Terms and Conditions will be effective unless set forth or approved in writing by the Senior Vice President of Sales of BPHA.
Wheelchair/Companion Seating Fraud. The TD Garden reserves the right to take appropriate action up to and including investigation, relocation, ejection, or season ticket revocation for wheelchair/ companion seating ticket fraud. Wheelchair/companion seating ticket fraud includes, but is not limited to, misrepresentation of a disability for the purpose of obtaining wheelchair/companion seating.
Term of Season Tickets. For purposes of this Agreement, the "Term" shall consist of the current season's playoffs (should the Boston Bruins qualify for the NHL Stanley Cup playoffs) and the following preseason and regular season.
Automatic Renewal. – BPHA reserves the right to implement automatic renewal for Season Tickets for any future renewal Term in accordance with these Terms and Conditions. After opting-in to automatic renewal, each year you will receive a written notification ("Notification Message") of an impending automatic renewal date, determined by BPHA in its sole discretion (“Automatic Renewal Date”) for your Season Tickets, any change to the price of your Season Tickets for the new Term, and/or any material change to this Agreement. Your Notification Message shall be provided at least thirty (30) and no more than sixty (60) days prior to your Automatic Renewal Date. Such Notification Message may, in BPHA’s sole discretion, include an option to decline the purchase of the current season's playoff tickets (should the Boston Bruins qualify for the NHL Stanley Cup playoffs). You may cancel your Season Tickets before they are automatically renewed for the new Term or, as applicable, decline to purchase the current season's playoff tickets (if such option is made available to you by BPHA), by opting-out before the Automatic Renewal Date. You may also cancel your Season Tickets for any future Term for any reason on any date prior to the Automatic Renewal Date for that Term, subject to this Agreement.
You hereby agree as follows:
“I ACKNOWLEDGE THAT IF I OPT-IN TO AUTOMATIC RENEWAL, MY SEASON TICKETS WILL AUTOMATICALLY RENEW EACH YEAR FOR THE UPCOMING TERMUNLESS I OPT-OUT PRIOR TO THE AUTOMATIC RENEWAL DATE OR UNLESS BPHA, FOR ANY REASON, DECLINES TO OFFER ME A RENEWAL TERM. I UNDERSTAND THAT I WILL RECEIVE AT LEAST THIRTY (30) AND NO MORE THAN SIXTY (60) DAYS PRIOR WRITTEN NOTICE OF THE AUTOMATIC RENEWAL DATE.”
Recurring Payment Authorization. You hereby agree as follows:
“I hereby authorize BPHA to charge my credit or debit card (or withdraw from my bank account via Electronic Funds Transfer, if so selected by me), for the purpose of paying for my Season Tickets for each Term. For all Season Ticket payments, the foregoing payment authorization shall remain in effect, subject to change by BPHA, for as long as I am a Season Ticket holder. In the event I cancel my Season Tickets for any future Term (as set forth above), I understand that I will no longer be obligated for any payments to BPHA for future Terms, but I will continue to remain responsible for making any payments remaining for the current Term, under this Agreement.
Agreement. Your use of Season Tickets is conditioned upon your acceptance and compliance with this Agreement. BPHA may, at any time and in its sole discretion, revise the terms of this Agreement. The most current version of this Agreement (and BPHA’s season ticket policies and procedures) will always be available at https://www.nhl.com/bruins/tickets/seasonticketholder/terms-conditions. If any revision to this Agreement is material, BPHA may, in its sole discretion, provide you with written notification of such revision. By continuing to use your Season Tickets after the revised Agreement becomes effective, you agree to be bound by the revised Agreement.
