Olympia Entertainment Events Center, LLC, (“Entity,” “us,” “our,” or “we”), and our internet service provider vendor, provide public network connectivity (the “Service”) as a courtesy to our Little Caesars Arena guests, including guests of our partner organizations, the Detroit Red Wings, Inc., Detroit Pistons Basketball Company, and 313 Presents, LLC. By using the Service, you agree to be bound by the following terms and conditions (“Terms”), which are a binding agreement between you and Entity. If you access or otherwise use the Service, you represent you are at least the age of majority. If you are under the age of majority, you represent that if you access or otherwise use the Service, you will do so under the supervision of a legal guardian who agrees to be bound to these Terms on your behalf.

Acceptable Use of the Service

You agree to only use the Service for the limited purposes of accessing the public Internet for purposes consistent with these Terms. Your use of the Service does not grant you any intellectual property rights to the Service or the information, documents, products, or software provided through this Service.

Use of the Service for any of the following is prohibited:

• Sending unsolicited bulk and/or commercial messages;
• Misrepresenting your identity or impersonating another person;
• Engaging in any activity that encroaches on another’s rights or invades another's privacy;
• Infringing or misappropriating the intellectual property rights of others;
• Advertising, soliciting, transmitting, storing, posting, displaying, or otherwise making available (i) obscene or indecent images or other materials, or (ii) any software, product, or service that is designed to violate these Terms;
• Transmitting, posting, uploading, or otherwise making available defamatory, harassing, abusive, or threatening material or language;
• Accessing illegally or without authorization computers, accounts, equipment, or networks belonging to another party, or attempting to penetrate security measures of another system (this includes any activity that may be used as a precursor to an attempted system penetration);
• Creating or distributing information regarding malicious code or other malware, pinging, flooding, mail-bombing, or denial of service attacks or similar disruptions;
• Participating in activities that disrupt the use of, or interfere with the ability of others to effectively use, the Service or any other network, system, service, or equipment;
• Transferring technology, software, or other materials in violation of applicable export laws and regulations;
• Selling, transferring, or renting the Service to any third party either directly or as part of a service or product created for resale;
• Encouraging of, attempting of, or participating in any action that violates laws, regulations, or court or government orders.

Access to and Termination of the Service

The Service is provided to you at the discretion of Entity, and Entity may, at any time and for any reason (including if you violate these Terms), block, restrict (partially or fully), or terminate your access to or use of the Service. Additionally, Entity may use content filtering services to block access to certain websites or content.

Entity reserves the right to take any action at Entity’s discretion to protect users of the Service, other visitors of the Arena, and Entity and its partners. This includes reporting any unauthorized or prohibited access or use of the Service, including the browsing or downloading of illegal information from the Internet through the Service, to government authorities, or taking legal action.

Data Security and Privacy

Although we use reasonable efforts to safeguard information, transmission via the Internet is not completely secure and we cannot guarantee the security of your information collected through the Service.

By accessing and using the Service, you agree that Entity, and its vendors (including the internet service provider that provides the Service to you) may collect personal information in connection to your use of the Service, including personal information required from you to enable your access to the Service. For example, we may require you to provide your name and email address to enable the Service on your device, and we, or our vendors, may be required to process your IP address, device identifier, or other unique identifier for the Service to function. You acknowledge and agree that Entity is not responsible for the privacy practices of its partners and affiliates. Entity recommends that you review the privacy policies of its partners and affiliates before providing your name and email address to them.

The Service may allow you to access websites or other online services not controlled by Entity. Entity is not responsible for the data practices of any online service not controlled by Entity.

Disclaimers

Entity makes no representation that the Service is appropriate or available for any particular use or purpose, and you are responsible for compliance with any laws applicable to your use of the Service. Entity does not guarantee the accuracy, copyright compliance, legality, integrity, quality, or decency of any content you may access using the Service. Entity does not guarantee the connectivity, speed of the Service’s bandwidth (including how quickly webpages or apps load, download, or transmit), consistent access to the Service, or that the Service is error-free. You agree to access or use the Service at your own risk and that your device or Internet data provider may charge you for accessing the Internet while using the Service due to Service connectivity inconsistency. You may choose to set your device to only access the Internet when the device is connected to a Wi-Fi service, but this still does not guarantee that the Service will mitigate any charges you receive from your data or device provider.

You acknowledge that providing the Service without charge is based on the limited warranty, disclaimer, and limitation of liability specified in this section, and a substantial charge would be required if any of these provisions were unenforceable. THE SERVICE IS PROVIDED IN AN "AS IS", "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, INCLUDING ANY RELATED TO NONINTERRUPTED OR ERROR-FREE SERVICE ACCESS. ALL WARRANTIES, CONDITIONS, REPRESENTATIONS, INDEMNITIES, AND GUARANTEES WITH RESPECT TO THE CONTENT OR SERVICE AND THE OPERATION, CAPACITY, SPEED, FUNCTIONALITY, QUALIFICATIONS, OR CAPABILITIES OF THE SERVICE, PROVIDED HEREUNDER, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW, CUSTOM, PRIOR ORAL OR WRITTEN STATEMENTS, OR OTHERWISE (INCLUDING, BUT NOT LIMITED TO ANY WARRANTY OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT) ARE HEREBY OVERRIDDEN, EXCLUDED, AND DISCLAIMED.

Release and Indemnity

By using the Service, you release and discharge Entity from any liability arising from your access or use of the Service, including your actions while using the Service, but not limited to, liability, whether foreseeable or not, in relation to defamatory or offensive material, data security, copyright violation, and consequential, indirect, special, punitive, or incidental damages or lost profits which may occur as a result of use of the Service.

You agree to indemnify and defend and hold harmless Entity, its employees and agents, from and against all loss, damage, liability, charge, expense (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising out of or related to your actions taken to access the Service, use of the Service, any materials downloaded or uploaded through the Service, any actions taken by you in connection with your use of the Service, any violation of any third party’s rights or violation of law or regulation, or any breach of these Terms. This section will not be construed to limit or exclude any other claims or remedies that Entity may assert under these Terms or by law.

Governing Law

You agree that your access to and use of the Service is subject to these Terms, as well as all applicable laws, as governed and interpreted pursuant to the laws of the State of Michigan, without regard to Michigan’s choice of law principles.

Interpretation

If any provision of these Terms is held to be unenforceable, in whole or in part, such holding will not affect the validity of the other provisions of these Terms. Nothing contained in these Terms shall waive or impede Entity’s right to comply with law enforcement requests or requirements relating to your use of the Service or information provided to or gathered by Entity with respect to such use. These Terms constitute the complete and entire statement of all terms, conditions, and representations of these Terms between you and Entity with respect to their subject matter and supersede all prior writings or understanding.
